MR. NED SIEGFRIED: Defective products cases, any product that's put in the stream of commerce that causes injury to its user could potentially spawn a products liability case, or a defective products case. If I took a bat and just for the, for kicks, or maybe I got mad at you, thumped you over the side of the head with it, we couldn't sue, we wouldn't have a claim against Louisville Slugger because I'm not using that bat in a, in the manner that it was intended. I've used it as a weapon. But if somebody is using, let's say a toaster, and it, and they're using it for what it's intended to be used for, i.e., toasting bread, and the toaster malfunctions and it catches on fire and burns the house down and people in the house suffer injury or death as a result thereof, that may give rise to a case, because the product that was being used is being used as it was intended, and it didn't perform as it was intended, and that resulted in injury and/or death.
So, defective products cases are very expensive to prosecute. They involve, you know, a lot of times very, very complex issues, and very technical issues, depending on the, you know, the product that we're dealing with. So here again, it's important that you don't hire an attorney that's taking his maiden voyage on your products case. So, as always, find out who you're hiring. Don't just like the person because he's cute or has a nice smile or has twinkle in his eye. Find out, really, what the level of experience and competency that that person has before you sign on the dotted line and hire him.
