Defective Products

A defective product is a product that causes injury or death to a person or damage to property as a result of errors in design, manufacturing, or labeling. Almost any kind of commercially available product could potentially be defective, and it is surprisingly common for people to be injured by defective products. Examples of defective products include: prescription and over-the-counter drugs, sports equipment, cars, exercise machines, defibrillators, baby cribs, food, etc.

In principle, anyone injured or otherwise harmed by a defectively designed, manufactured, or labeled product may have a product liability claim. In practice, product liability claims can be very complex given the number of people and businesses involved in bringing a product to market and selling it.

Product liability claims can be based on allegations of negligence which focuses on the actions of the manufacturer, distributor, etc. More often than not, however, product liability claims are based on the principle of strict liability which focuses on problems with the product itself. For example, the absence of a safety guard on a piece of heavy machinery would constitute a defective design.

Victims of product liability are entitled to compensation for medical expenses, rehabilitation costs, diminished earning capacity, property damage, lost income, and other costs and losses.
