Grantsville, UT – Man Charged After Striking Child in Fatal Pedestrian CrashUtah Legal News
Grantsville, UT (March 2, 2019) – Police have charged a man with child abuse and homicide following a fatal pedestrian crash after a child ran into the road and was struck. The suspect has since been identified as 73-year-old Michael Montgomery.
Officers discovered that there were multiple reports of a young toddler wandering out of his home, where he lived with Montgomery and his mother, and entering the streets.
On one occasion, a police officer responded to Burmester Road to find that a driver was in need of help. As the officer approached the driver, he noticed that he was holding a small child. On another occasion, Montgomery allowed the child to get out of a back gate, where he then walked around town pushing a stroller until he was found.
The final event took place when a deputy was dispatched to the scene of a fatal pedestrian accident. Deputies found that the small child who had been struck by a vehicle was the same one who had gotten out of his home numerous times throughout several months.
When the child was taken to the hospital, he was tragically pronounced deceased. The first driver who struck the child said that they were traveling along when the child darted out and she struck him. She did not know that she struck a person until she saw the child in the rearview mirror. Authorities discovered that another vehicle, identified as a yellow truck, struck the child as well but never stopped.
Montgomery had allegedly fallen asleep and, when he woke up, the toddler had disappeared. Police now claim that Montgomery acted with criminal negligence and that he should have known that the toddler would try to escape once again.
Police continue their investigation at this time.
